After she entered the border of the United States, she sincerely stated to the officer that she flee to the United States to seek asylum and the identity was not hers.

After Ms. Paul was found having credible fear to return to Guyana, she was later placed onto the removal proceeding. However, she was undergone pregnancy during the time when the most recent hearing taken place where a deportation order in absentia was issued to her.

The sole reason that she could not attend was she could not afford a lawyer and she was scared that attending to the court alone may get her immediately deported.

Throughout the years, Ms. Paul has filed multiple green card application with the USCIS. She sincerely believed that she cannot and is not eligible to adjust her status unless her husband becomes a U.S. citizen.

In 2022, Ms. Paul’s husband officially sworn under oath to become a U.S. citizen. Later on, a new I-130 was filed and designates Ms. Paul as the beneficiary and I-485 was filed thereafter. On November 08, 2023, the I-130 petition was approved by the USCIS.

The Extreme Hardship that Ms. Paul’s USC Husband May Experience if Ms. Paul has to relocate back to Mexico:

Ms. Paul’s family household consists of four family members, Ms. Paul, her USC husband and two minor children who currently are 19 and 7 years old. There is no doubt that if Ms. Paul cannot continue being the housewife of the household. Ms. Paul’s USC husband will have more economic and emotional burden on taking care of two minor children.

In addition, Ms. Paul’s USC husband is on medication for high blood pressure, diabetes and cholesterol every day. Even though the health condition of Ms. Paul’s USC husband is management, his mental health can be severely affected if Ms. Paul relocates back to Mexico.

Moreover, Ms. Paul currently is not in good health condition and Ms. Paul’s husband needs to find Ms. Paul a reliable hospital and doctor for treatment if she relocates back to Mexico. The uncertainty of the new doctor and the standard of the hospital plus the fee to be required by the hospital can add additional and severe mental distress onto Ms. Paul’s USC husband.

Lastly, Ms. Paul has been a full-time housewife since her marriage with her USC husband. It is not possible for her two USC children to move to Mexico with her together to adjust a complete different education system and living standard. Further, that may cause severe stress to the two children if relocation to Mexico is necessary because of their mother’s immigration status. They will on the contrary suffer emotional turbulence as well if they remain in the United States but their beloved mother has to restart a life in Mexico.

The medical record of Ms. Paul reflects the current medical attention she seeks on a monthly or even a weekly basis. The tax record of Ms. Paul’s household shows Ms. Paul and her USC husband have built a household with genuine love, hardworking and honesty. Thus, Ms. Paul deserves deference on her I-601 waiver application.

Wherefore, in viewing the circumstances mentioned above, the undersigned sincerely asks the USCIS to approve this instant I-601 waiver application to waive any immigration law related violation made by Ms. Paul unintentionally.
